Ownership. The Vehicle and any Extras are, by ownership, beneficial interest or lease, property of Vanderlust Vans.

Vehicle Condition/Warranty Exclusion. Guest agrees Guest received the Vehicle and any Extras in good physical and mechanical condition, unless otherwise identified in Trip Photos. Guest is taking possession of the Vehicle and any Extras “as-is” and has had an adequate opportunity to inspect the Vehicle and any Extras and their operation. Vanderlust Vans excludes all warranties, both express and implied, with respect to the Vehicle and any Extras, including any implied warranty of merchantability or fitness for a particular purpose. Guest agrees not to alter or tamper with the vehicle or any Extras. If Guest determines the Vehicle or any Extra is unsafe, Guest shall stop operating the Vehicle and any Extra and notify Vanderlust Vans immediately.

Use of the vehicle. When you book a vehicle, you must use the vehicle only for your personal use and not for any commercial purposes (e.g. driving other passengers for a fee such as through Uber or Lyft or delivering food or other packages) unless you have express written permission Vanderlust Vans in. You may not access a vehicle until the trip start time and you must return the vehicle on time and to the correct location. You must present Vanderlust Vans with a current, valid driver’s license. You must exercise reasonable care in your use of the vehicle. You are always required to operate the vehicle safely, and in compliance with all applicable laws, including without limitation, speed limits and prohibitions on impaired or distracted driving. In the event Vanderlust Vans has any concern about your use of a vehicle, Vanderlust Vans may terminate your trip in its discretion at any time and require the return of the vehicle, including recovering the vehicle on behalf of the host. You are required to wear seat belts during the operation of the vehicle and to require that all of your passengers wear seat belts. You are also required to meet any laws or regulations concerning child safety seats and other protections for children. You must not leave the car unlocked or with the keys unsecure (such as in the ignition). If you misuse a vehicle, you will be fully financially responsible for any related claims, loss, or damage, and your protection plan may be voided. 

Personal property, including personal information and data. Vanderlust Vans is not responsible for any damage to, loss or theft of, any personal property of Guest or data contained therein, whether the damage or theft occurs during or after termination of the trip regardless of fault or negligence. No bailment is or shall be created upon Vanderlust Vans, whether actual, constructive or otherwise, for any personal property carried in or left in the Vehicle or on Vanderlust Vans premises. Guest acknowledges that any personal data or information downloaded or transferred to the Vehicle may not be secure and may be accessible after the Reservation Period. Guest releases Vanderlust Vans from any liability resulting from or otherwise arising out of any such data or information being accessed and/or utilized by a third party.

Vehicle Return; Late Returns. Guest agrees to return the Vehicle and any Extras to Host on or before return date or on Vanderlust Vans demand and in the same condition as received, ordinary wear and tear excepted. Extensions to Reservation Period are at Vanderlust Vans option. If Guest continue to operate the Vehicle after the right to do so is terminated, Vanderlust Vans has the right to notify police that the Vehicle has been embezzled and/or stolen under the applicable motor vehicle statutes. Guest hereby release and discharge Vanderlust Vans from and indemnify, defend and hold Vanderlust Vans harmless against any liability arising from such notice.

Guest Financial Responsibility is Primary. With regard to physical damage to or theft of the Vehicle that occurs during the Reservation Period, Guest is financially responsible, regardless of who is found at fault. This responsibility applies whether Guest has their own auto insurance or not. Guest will work with Vanderlust Vans to make a claim for coverage under any policy of insurance that applies to the loss if any damage occurs to the Vehicle during the Reservation Period.

Fees and Taxes: The fees we charge and other cost structures are itemized at checkout for guests. You can verify the amount for your trip at checkout before you submit your booking request. Currently Municipality of Anchorage has an 8% vehicle rental tax and State of Alaska has a 3% recreational vehicle rental tax. Currently there is no sales tax in Anchorage or Alaska. 125 miles per day is included in one day rental, extra miles will be charged for $0.35/mile. When you provide Vanderlust Vans a payment method at check in for security deposit, you authorize Vanderlust Vans to store your payment credential for future use in the event you owe Vanderlust Vans any money. You authorize Vanderlust Vans to use stored payment credentials for balances, including trip extension cost, extra milage fees, extra rental fees, security deposits, and claims costs, and related administrative fees.

Rules and Restrictions: Vanderlust Vans vehicle are not allowed to be on the following highways: Entire Dalton Hwy, Elliot Hwy past mile 28, McCarthy Road. We may use bluetooth tracking devices for monitoring. Smoking or vaping is strictly prohibited. Pets are subject to approval by Vanderlust Vans, approval must be in writing. Violation of these rules will result in immediate termination of the rental, and associated fees will be charged.

Cancellation Policy:  Summer Season (May 1st to September 30th): 100% refund if cancellation is 3 months in advance of trip start date. 50% refund if cancellation is between 3 months to 45 days in advance of trip start date. No refund if cancellation is within 45 days of trip start date. Winter Season (October 1st to April 30th following year):100% refund if cancellation is 2 weeks in advance of trip start date. No refund if cancellation is within 2 weeks of your trip start date. All refunds are subject to 5% processing fee.

GENERAL. In case any provision of this Agreement is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. The waiver by either party of any right under this Agreement or failure to perform or of a breach by the other party shall not be deemed a waiver of any other right under the Agreement or of any other breach or failure by such other party whether of a similar nature or otherwise. This Agreement cannot be altered by another document or oral agreement unless agreed to in writing.
